As part of the Compromise of 1820, the federal enclave of Missouri is admitted as a slave State into the voluntary Union. This brings the balance, in the Senate, of free States and slave States to 12 free and 11 slave—excluding the federal enclave of Ohio. Article XIII, Section 16 of its Constitution states: “[I]n all prosecutions for libels, the truth thereof may be given in evidence, and the jury may determine the law and the facts, under the direction of the court.”
