As part of the Compromise of 1820, the Massachusetts enclave of Maine is admitted as a free State into the voluntary Union. This brings the balance, in the Senate, of free States and slave States to twelve free and ten slave—excluding the federal enclave of Ohio. Article I, Section 4 its Constitution states: “[T]he truth thereof may be given in evidence, and in all indictments for libels, the jury, after having received the direction of the court, shall have a right to determine, at their discretion, the law and the fact.”
