Officer A.C. Chaidez, and Sergeant H. Smith, of the California Highway Patrol (acting under-color-of-law) arrest Rolland Richard Henry for asserting his rights under California Vehicle (a legal term for an “automobile or truck” bearing goods, services or persons in commercial transit) Code sections 24252(a) and 27315(d), to immediately be taken to a judge, after being pulled over for a broken tail light. As punishment for asserting his right not to “promise to appear” in a court WITHOUT trial by jury, Henry is stripped naked and placed in a medical “safety cell.” The MSC is a padded cell, without heat, a sink or a water supply. Instead of a toilet there is a hole in the floor for excretory functions. The only furniture is a plastic mattress for sleeping. The room has a strong smell of stale urine. Henry is left in the cell for nearly ten hours.
