ELECTION DAY: voters in oregon pass Ballot Measure 91 (YEA, 56%; NAY, 44%); voters in the Federal enclave of Alaska pass Ballot Measure 2 (YEA, 53%; NAY, 47%) and voters in the District of Columbia pass Initiative 71 (YEA, 70%; NAY, 30%). All three referendums legalize the recreational use of marijuana. This raises the number of “states” (as defined by the Buck Act of 1940) to five that have nullified Federal anti-marijuana statutes within their jurisdictions. Although CONgress has the lawful power under Article I, Section 8 [Clause 17] to nullify Initiative 71.
