The Supreme Court, of the corporate United states, hands down Elgin National Watch v. IllinoisWatch Case, declaring the Trade Mark Act of 1881 to be lawful. This time the court’s reason is not based on Article I, Section 8 [Clause 8] (the Patent and Copyright Clause), but on Article I, Section 8 [Clause 3] (the Commerce Clause).
