The Supreme Court, of the corporate United states, hands down Wilson v. Shaw: Article I, Section 8 [Clause 3] (the Commerce Clause) authorizes the “construction and operation ” of national highways by Congress.
NOTE: The Commerce Clause does not mention roads or highways, only commerce; it was intended by the framers and ratifiers to prevent the States from erecting trade barriers between themselves. Article I, Section 8 [Clause 7] does authorize Congress “To establish Post Offices and post Roads”; but does not authorize Congress the power to “construct or operate” them.
