The supreme court, of the corporate United states, hands down Sonzinsky v. United states, upholding the National Firearms Tax as lawful: “Every tax is in some measure regulatory.  To some extent, it interposes an economic impediment to the activity taxed, as compared with others not taxed.”

       The Constitutional counter-Revolution of 1937 continues: The supreme court, of the corporate United states, hands down West Coast Hotel v. Parrish, declaring—via the fraudulent 14th amendment—state minimum wage statutes to be lawful.

       NOTES:

  • In the Opinion of the Court, this decision purportedly overturned Adkins v. Children’s Hospital, although that decision originated in the District of Columbia, which is under the exclusive jurisdiction of CONgress.
  • Ten months previous the court came to the opposite conclusion in Morehead v. New York ex relatione Tipaldo, but did not overturn the former.

       Postscripts:

  • As a result of this decision the “Roosevelt Recession” (an economic downturn within the Great Depression) intensified as New Deal regulations on business rapidly increased.  This in turn led to a dampened business climate that caused unemployment to return to 1931 levels.
  • Federal regulations rapidly increased deepening the Great Depression.
  • Ten months previous the court came to the opposite conclusion in Morehead v. New York ex rel. Tipaldo, but did not overturn the former.
  • By the time the anti-Constitutional Revolution of ’37 ended 13 months later, the court had transformed itself into an on-going constitutional convention, amending the Constitution for the united States by judicial decree.
