Democratic (constitutionalist) President Buchanan vetoes the Homestead Act of 1860, which would have opened up indigenous American lands to settlers of European descent: “[T]he facts raises the question whether Congress, under the Constitution, has the power to give away the public lands either to States or individuals.”
