The Electorate of New Jersey ratifies its Constitution of 1844, Article I, Section 5 of which states: “In all prosecutions or indictments for libel, the truth may be given in evidence to the jury; ends, the party shall be acquitted … and the jury shall have the right to determine the law and the fact.”
