William Phillips, Under Secretary of State, certifies the 21st amendment, purporting to repeal the 18th amendment (prohibition), has received the requisite ratification of three-fourths of the states—this despite it NOT having been proposed by a lawfully elected (within the provisions of Article I, Section 3 [Clause 1]) senate.

       NOTE: Section 1 of the amendment supposedly repeals the 18th amendment.  Although authority to regulate the manufacture and sale of intoxicating liquors is returned to the states, Section 2 retains the Federal “prohibi[tion] of the transportation or importation … of intoxicating liquors.”
