A lawfully elected Senate (in accordance with Article I, Section 3 [Clause 1]) acquits the impeached War Democrat (constitutionalist) de facto President Andrew Johnson (of the confederate State of Tennessee) (guilty, 35; not guilty, 19). Thirty-six guilty votes (two-thirds) were necessary to remove Johnson from office.
NOTE: Edwin M. Stanton, Secretary of War, who was at the center of the controversy, submitted his resignation to Johnson that very same day.
