The Third American Revolution begins: Under the authority of the Trading with the Enemy Act (an act which is supposed to be null and void during peacetime), de facto Commander-in-Chief Franklin Roosevelt, Esq. issues (the Bank Holiday) Proclamation 2039, halting the minting of silver Dollars, suspending the redemption of Federal Reserve Notes for gold, closing the nation’s private banks for four days, and declaring all United states subject citizens to enemies of the U.s.:

       WHEREAS it is provided in Section 5(b) of the Act of October 6, 1917 “That the President may investigate, regulate, or prohibit, under such rules and regulations as he may prescribe, by means of licenses or otherwise, any transactions in foreign exchange and the export, hoarding, melting, or earmarkings of gold or silver coin or bullion or currency * * *; and

       WHEREAS it is provided in Section 16 of the said Act “that whoever shall willfully violate any of the provisions of this Act or of any license, rule, or regulations issued hereunder, and whoever shall willfully violate, neglect, or refuse to comply with any order of the President issued in compliance with the provisions of this Act, shall, upon conviction, be fined not more than $10,000, or if a natural person, imprisoned for not more than ten years, or both; * * *:

       NOW, THEREFORE, I, FRANKLIN D. ROOSEVELT, President of the United States of America, in view of such national emergency and by virtue of the authority vested in me by said Act and in order to prevent the export, hoarding, or earmarking of gold or silver coin or bullion or currency, do hereby proclaim, … that … all banking transactions shall be suspended. …

       NOTES:

• The asterisks in the proclamation are text that does not exist in the TWEA, but refer to text which is to be added at a future time;
• As an attorney (Officer of the Court) Roosevelt was ineligible to serve in two branches of government at the same time, according to Article I, Section 6 [Clause 2].
• The Trading with the Enemy Act was structured to be automatically repealed with the ratification of the peace treaty with Germany.

       However, the duplicitous FDR had a candidate for Attorney General provide an opinion that could be construed to say that the Act in question had only been partially repealed, and that a President could still invoke it.   So much for Due Process under FDR. —- JL
