The supreme court, of the confederate state of tennessee, hands down, Scopes v. state: overturning the conviction of John T. Scopes for teaching Darwin’s theory of evolution in a government-run public school, and declaring the Butler Act—which Scopes violated—as unlawful.

       NOTE: Were parents free to exclusively tender their full financial support to schools of their choice for their children, there would be no public controversy over evolution or creationism, as children would be receiving an education in accordance with the wishes of the parents—not the state.
